1. Introduction

Welcome to WebAcer Software. By accessing or using our services, you agree to comply with these Terms & Conditions.

2. Definitions

“Company” refers to WebAcer Software. “User” refers to anyone accessing our website or services.

3. Use of Services

Users must comply with applicable laws and refrain from any unauthorized or harmful activities.

4. Account Registration & Security

Users are responsible for maintaining their account security. WebAcer Software is not liable for unauthorized access.

5. Payment Terms

Fees quoted are valid for 30 days from the date of issue. Our payment schedule varies based on project budget:

For Projects Over $5,000:

  • 30% invoiced upon sign-off. Work starts after payment.
  • 40% invoiced upon design approval.
  • 20% invoiced before completion and must be paid before going live.
  • 10% invoiced on deployment.

For Projects Between $1,000 – $5,000:

  • 50% invoiced upon sign-off.
  • 40% invoiced before completion.
  • 10% invoiced on deployment.

For Projects Up to $1,000:

100% payment required upfront.

6. Intellectual Property Rights

WebAcer Software retains ownership of reusable components and proprietary code. Upon full payment, clients get exclusive ownership of custom designs and branding.

7. Maintenance

Content Maintenance

Offered hourly or via contract. Clients must provide updates timely.

Software Maintenance

Ensures compatibility with latest stable browsers and platforms at delivery.

  • Supported Platforms: Windows, macOS, Linux
  • Supported Browsers: Chrome, Firefox

Future compatibility not guaranteed unless under contract.

8. Project Delays

If client delays exceed 60 days, WebAcer Software may:

  • Charge a 10% restart fee.
  • Reschedule based on availability.

If WebAcer Software delays exceed 21 days, clients get timeline updates and potential compensation.

9. Bug Fixes & System Errors

One-month free bug fixes for critical errors. Minor design changes or additions are billable.

10. Termination Policy

If a client cancels before work starts, they receive a full refund. If canceled after work starts:

  • Payments are non-refundable.
  • Completed work billed at an hourly rate.
  • Outstanding balances must be cleared before file handover.

If WebAcer Software cancels, unused fees are refunded.

11. Liability Limitations & Force Majeure

WebAcer Software is not liable for losses due to:

  • Website malfunctions beyond our control.
  • Delays from third-party providers.
  • Client’s failure to provide materials.

Force majeure events (e.g., disasters, cyber-attacks) may impact services.

12. Complaints & Dispute Resolution

Informal Complaints

Clients should first contact their Project Manager or email support@webacers.com. Response within two business days.

Formal Complaints

Submit written complaints for resolution within 30 days.

13. Changes to Terms

WebAcer Software may update these terms anytime. Clients will be notified via email.

14. Governing Law & Jurisdiction

These terms are governed by the laws of Panchkula, Haryana, India.
